Reasons leading to the appointment of a psychological and pedagogical examination
Psychological and pedagogical expertise in family disputes is important. Examination can be carried out both when resolving issues regarding common children, and when resolving property disputes between spouses.
Often in judicial practice there are situations when, in order to more quickly resolve the issue of determining the place of residence of a child, or determining the procedure for communicating a child with a parent living separately, a psychological and pedagogical examination is required. Such an examination may be appointed at the initiative of the court or the plaintiff or defendant (for example, when considering divorce cases).
The goals of psychological and pedagogical expertise
Appointment of psychological and pedagogical expertise is carried out in order to:
– establishing the personal qualities of a parent or child;
– determining the degree of attachment of the child to the parent;
– addressing the issue of the order of communication of the child with a separately living parent.
Questions answered by psychological and pedagogical expertise
Psychological and pedagogical examination of the child will answer the following questions:
– which parent is the child more attached to?
– what are the psychological features of raising a child in a family;
– what is the relationship of the child to the parent with whom he does not live;
– Other matters related to the family dispute.
The difference between psychological and pedagogical expertise and forensic psychiatric expertise
A forensic psychiatric examination of an adult will provide answers to the following questions:
– in what mental state a person (spouse, ex-spouse) was when he committed legally significant actions (including powers of attorney, donation agreements, purchase and sale of real estate, etc.).
As follows from the foregoing, a psychological and pedagogical examination can be carried out in relation to a child or a parent, and when resolving litigation arising from property legal relations, a forensic psychiatric examination should be carried out.
Requirements for an expert conducting a psychological and pedagogical examination
The requirements for an expert are as follows:
– competence;
– impartiality.
The expert must have sufficient qualifications to conduct an examination, in particular, have a higher education or a degree in pedagogy, psychology or psychiatry. An expert conducting an examination in relation to a child must necessarily have a pedagogical education, know the characteristics of the child’s psyche, and take into account the age characteristics of the child.
If an examination of the mental state of a person is carried out, then the expert must have knowledge in the field of psychiatry. An expert must be qualified to assess whether a person is in control of his actions and whether he understands their significance. This is especially important in property disputes between former spouses.
When conducting an examination, an expert should not have an interest in the outcome of a family dispute, he should be impartial. If the dispute concerns the property of former spouses, then the expert should not have the goal of enriching at the expense of one of the parties to the dispute, etc. This is one of the requirements for an expert – impartiality.
