When the family is spread across more than one country — a parent in Belarus and children who have settled abroad, a marriage between two nationalities, a home here and savings somewhere else — the question of what happens to the inheritance can feel bewildering on top of the grief, and it is easy to assume the whole thing will be impossibly tangled. It is more involved than a straightforward domestic inheritance, that much is true. But it is not a maze, and there is one idea that makes sense of almost all of it: in a cross-border inheritance, which country’s law applies is not decided once for the whole estate — it depends on the type and location of each asset. Once you see that, the pieces fall into place, because it tells you which rules govern what. This article walks a mixed-nationality family through how a cross-border inheritance actually works in Belarus, calmly and in plain terms, so that a difficult time is at least not made harder by not knowing what to expect.

We will start with that central idea — which law applies to which asset — because everything else rests on it. Then we will look at how a will can change the picture and who is protected regardless of one; who actually handles an inheritance in Belarus; the six-month deadline that most often catches families living abroad; what foreign heirs need to prepare; and whether, and how, a foreigner can inherit property here. We will finish with a plain list of what to do. Throughout, the theme is a reassuring one: a cross-border inheritance is not a single overwhelming process but a coordination of a few manageable ones, and a family that understands the shape of it — and gets the right help — can navigate it without the whole thing feeling out of control.

Which law applies depends on the asset

This is the idea that unlocks everything else, so it is worth taking slowly.

It is natural to assume that a person’s nationality decides which country’s law governs their inheritance — that a Belarusian’s estate follows Belarusian law and a foreigner’s follows theirs. That is not how it works. As a general rule, Belarusian law looks to the country where the deceased last lived, so it is their last place of residence, rather than their passport, that sets the default. But there is a crucial exception, and it is the one that matters most for a mixed family: real estate is governed by the law of the country where it sits. Property in Belarus is therefore governed by Belarusian inheritance law no matter where the deceased lived or what nationality they held. Put those two rules together and you get the key consequence: a cross-border estate can split. The flat in Minsk is dealt with under Belarusian law, while the bank accounts or the house in another country are dealt with under the law of the place the deceased last called home. That splitting is not a complication to be feared so much as a map to be read — once you know it, you know which rules apply to which part of the estate, and the rest follows. The rules that set all this sit in the Civil Code, available on pravo.by and etalonline.by.

When there is a will, and who is protected regardless

A will can shift the default picture, though not without limits, and both halves of that are worth knowing.

The default just described — last home for most things, location for real estate — can be changed by a will, because the person making it is allowed to choose the law of the country of their nationality to govern their inheritance. So a will is not just a list of who gets what; it can also decide which country’s rules apply, which for a mixed family can matter a great deal. A foreign will can be recognised in Belarus, too, provided it meets the requirements, so a will made abroad is not automatically worthless here. But a will does not have the last word on everything. Belarusian law protects certain close family members with a share of the estate they are entitled to regardless of what the will says — an obligatory share — and where Belarusian law governs, that protection reaches foreign heirs as well as local ones. So the picture is balanced: a will matters and should be taken seriously, including a foreign one, but it sits within protections that a family should know are there. Exactly who is protected, and by how much, is one of the things to check for your own situation rather than assume.

A Belarusian notary handles the Belarusian assets

Here the process becomes concrete and, for once, reassuringly simple to picture.

For the Belarusian part of an inheritance, you are not looking at a court case. Unless there is a genuine dispute among the heirs, inheritance in Belarus is handled by a notary, who opens the inheritance, establishes the heirs and what the estate contains, and issues the document that lets the assets pass — the certificate of inheritance. For a family scattered across countries, this is steadying news: for the Belarusian assets there is a clear official to deal with and a clear document to obtain, rather than an open-ended legal battle. The foreign parts of the estate are handled under their own countries’ procedures, with their own officials, which is exactly why a cross-border inheritance is a coordination rather than a single track — but the Belarusian side of it runs through the notary, and that is a well-worn path. The notarial profession’s own guidance is published by the Belarusian Notary Chamber, which is a useful point of reference, and much of the surrounding administration runs through the public-services portal.

The six-month deadline — and how to meet it from abroad

You must accept an inheritance within six months of the death. Accepting is a choice, not something that happens automatically, and if the six months pass without it being done, the position becomes much harder to put right. This is the point at which families abroad most often come unstuck — not through any fault, but simply because, grieving and far away, they did not know a clock was running. The reassuring part is that you do not have to be in Belarus, or drop everything and travel, to accept in time. You can accept from abroad by sending the notary an application with your signature certified where you are, or by appointing someone to act for you under a power of attorney, so that the acceptance is made on your behalf while you deal with everything else. The mechanics of acting through a representative from another country are the same ones we describe in our writing on handling a Belarusian matter from abroad. The one thing that is not flexible is the deadline itself, which is why knowing about it is, in a real sense, the protection — a family that knows to act within six months rarely loses the window, and one that does not, sometimes does.

What foreign heirs need to prepare

A little preparation here saves a scramble later, which matters when the clock is ticking.

A foreign heir has to show their right to inherit, and that comes down to documents — proof of the family relationship, the death certificate, and a will if there is one. Because these originate abroad, they generally have to be legalised, usually by apostille, and translated into a state language before a Belarusian notary can rely on them. None of this is difficult in itself, but it does take time, and time is the one thing in short supply when a six-month deadline is running, so the practical advice is simply to begin gathering and preparing the documents early rather than leaving them to the last weeks. A family that has its papers in order well before the deadline can accept calmly and on time; one that starts late can find the legalisation and translation turning into an anxious rush. This is also a place where a lawyer can save real trouble, by telling you at the outset exactly which documents you will need and in what form, so that nothing is discovered to be missing at the wrong moment.

Can a foreigner inherit property in Belarus — and what about tax?

Two questions foreign families ask again and again, with mostly reassuring answers and one thing to watch.

Yes, a foreigner can inherit property in Belarus, including real estate. Being a foreign national is not, in itself, a barrier to inheriting a Belarusian home or other property, and families sometimes worry about this more than they need to. There is, though, one point to watch: certain kinds of land can carry restrictions on foreign ownership, which can mean a foreign heir inherits the value of such land but has to sell it or deal with it in a particular way rather than simply hold it. That is worth knowing in advance so it is not a surprise, and it is exactly the sort of detail to check for the specific property involved. On tax, the general position is more comforting than many expect: an inheritance passing to close relatives is usually free of income tax, though inheritances to others may be treated differently, so the tax question, like the land question, is one to confirm for your particular circumstances rather than assume either way.

What to do: a practical path

If you are facing this now, here is the shape of it, reduced to steps you can actually take.

Start by working out which law governs which part of the estate — Belarusian real estate under Belarusian law, movable property under the law of the deceased’s last home — because that tells you where each part is dealt with. Find out whether there was a will, and whether it chose a particular country’s law, since that can change the default. Then act on the deadline: make sure the inheritance is accepted within six months of the death, from abroad through a certified application or a representative if you cannot be here. Gather and legalise the necessary documents early, so they are ready when they are needed. Use the Belarusian notary for the Belarusian assets, while the foreign parts of the estate are dealt with under their own rules. Above all, get a lawyer involved early. Cross-border inheritance, run against a six-month clock and across more than one legal system, is precisely the kind of thing that goes wrong when it is attempted alone — and precisely the kind of thing that becomes manageable with someone who has done it before.

A mixed-family inheritance, at a glance

Aspect

How it works

Watch out for

Which law applies

Real estate by where it sits; movable property by the deceased’s last home

A mixed estate can split between countries

Who handles it

A Belarusian notary, for the Belarusian assets

Not a court, unless there is a dispute

The deadline

Accept within six months of the death

Easy to miss when you are abroad

Foreign heirs

Can inherit; documents must be legalised and translated

Certain land may carry restrictions

Frequently asked questions

Which country’s law decides how the inheritance is divided?

It depends on the asset. As a general rule, Belarusian law looks to the country where the deceased last lived — but real estate is governed by the law of the country where it is located, so property in Belarus follows Belarusian inheritance law regardless of where the person lived. That is why a cross-border estate can split: the Belarusian property under Belarusian law, and movable assets under the law of the deceased’s last home. A will can change the default in some respects.

Does the deceased’s nationality determine everything?

No — this is a common misunderstanding. Nationality is not the default test; the deceased’s last place of residence is, for most of the estate, and the location of real estate is for the property itself. Nationality does become relevant if the person chose, in a will, to have the law of their nationality govern their inheritance — but absent that choice, it is where they lived and where the property sits that decide, not the passport they held.

Can a foreigner inherit property in Belarus?

Yes, including real estate — being a foreign national is not a bar to inheriting Belarusian property. The one thing to watch is that certain land can carry restrictions on foreign ownership, which may mean a foreign heir inherits the value but has to sell or deal with that land in a particular way rather than keep it. For most property this is not an issue, but it is worth checking for the specific property, which a lawyer can do quickly.

How long do we have to claim an inheritance?

Six months from the death. Accepting an inheritance is a choice that has to be made within that window, and letting it pass makes things much harder to sort out afterwards. This is the deadline that catches families living abroad most often, simply because they did not know it was running. You can accept from abroad without travelling, but you do have to act within the six months, so it is the first thing to be aware of.

Can I accept an inheritance from another country without travelling?

Yes. You can send the notary an application to accept the inheritance with your signature certified where you are, or appoint someone to act for you under a power of attorney so that the acceptance is made on your behalf. This lets a family member abroad meet the six-month deadline without dropping everything to come to Belarus. It is worth arranging early rather than close to the deadline, so there is time for documents to be prepared and sent.

Is a foreign will valid in Belarus?

It can be. A will made abroad can be recognised in Belarus provided it meets the requirements, so it is not automatically disregarded. A will can also choose the law of the deceased’s nationality to govern the inheritance. But a will does not override everything — certain close heirs are entitled to an obligatory share regardless of what it says. Whether a particular foreign will is valid and effective here is worth confirming rather than assuming, in either direction.

Do we have to pay tax on an inheritance?

Usually not, where it passes to close relatives — inheritance to close family is generally free of income tax, which is more reassuring than many families expect. Inheritances to others may be treated differently. As with much of this, the tax position depends on the particular circumstances, so it is worth confirming for your situation rather than assuming, but for most families inheriting from a close relative, tax is not the obstacle they fear.

Where to begin

If this feels like a lot to hold at a hard time, hold on to the one idea that organises all of it: in a cross-border inheritance, which law applies depends on the asset. Belarusian real estate is dealt with under Belarusian law, through a Belarusian notary who issues the certificate that lets it pass; movable property is dealt with under the law of the place the deceased last called home; and a will can adjust that default while certain close heirs stay protected either way. It is not one enormous process but a few manageable ones, coordinated across the countries involved — and the single most important thing to do is simple: make sure the inheritance is accepted within six months of the death, from abroad if need be, and start gathering the documents early.

You do not have to carry this alone, and you should not try to. A cross-border inheritance for a mixed family is more involved than a domestic one, but it is navigable, and it becomes far less daunting with someone beside you who has handled the splitting of an estate, the six-month clock, and the legalising of foreign documents before.
