One of them built or runs a business, and dreads that divorce will mean splitting it down the middle, handing a stake to an ex-spouse, or being forced to sell the thing they spent years making. The other is married to that person, and dreads walking away with nothing from a business they helped make possible and that their spouse controls. The honest starting point speaks to both, and it is worth saying plainly: a business built during the marriage is shared \u2014 but what gets shared is almost always its value, not the business itself. The spouse who runs it usually keeps it, and compensates the other for their share of what it is worth, which means the real contest is rarely over who ends up in charge. It is over what the business is worth and how the other spouse is fairly paid out. That single shift \u2014 from thinking about the business as a thing to be divided to thinking about its value as a sum to be shared \u2014 settles most of the fear on both sides, and it is where this article begins. What follows is how it works: whether the business is marital property at all, how it is actually divided, why valuation is where the fight really lives, and how a business can be protected.<\/p>\n\n<p class=\"wp-block-paragraph\">None of this is only for the spouse who owns the business; it matters just as much to the one who does not, because the same reframe that reassures an owner that they will not lose their company reassures the other that they will still receive their fair share of its worth. The subject has two sides, and so does the answer.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Is the business marital property?<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">The first question is whether the business is even up for division, and that turns on when and out of what its value came to be.<\/p>\n\n<p class=\"wp-block-paragraph\">A business interest acquired during the marriage \u2014 a share in a limited liability company, shares in a joint-stock company, a unitary enterprise, or the assets of a sole trader&#8217;s business \u2014 is jointly acquired property, shared between the spouses like anything else built during the marriage, and it makes no difference that only one spouse&#8217;s name is on it. A business that one spouse owned before the marriage, or inherited, or received as a gift, is that spouse&#8217;s own and stays out of the division. The line between the two, though, is rarely as clean as it sounds: a business owned before the marriage that grew substantially during it, or into which marital money or a spouse&#8217;s work was poured, can bring part of that growth or value into the shared pot even though the business itself started out as one spouse&#8217;s own. So the real starting question is not simply whose business it is, but when its value arose and out of what \u2014 and that is often less obvious than it first appears. The rules that govern it sit in the Code on Marriage and Family and the Civil Code, on <a href=\"https:\/\/pravo.by\/\">pravo.by<\/a> and <a href=\"https:\/\/etalonline.by\/\">etalonline.by<\/a>.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>How it&#8217;s divided: value, not a seat at the table<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Where the business is a company, its charter \u2014 or an agreement among its participants \u2014 commonly restricts who is allowed to hold a share. The other participants may have a right of first refusal, or their consent may be required before anyone new can join, precisely so that the company is protected from acquiring an unwanted co-owner \u2014 restrictions recorded, along with the company&#8217;s participants and shares, in the business register, the <a href=\"https:\/\/egr.gov.by\/egrn\/index.jsp?language=en\">Unified State Registry<\/a>. The consequence is that a spouse entitled to a share of the business usually cannot simply be handed a stake and a seat at the table: instead, they receive the value \u2014 compensation for their share of what the business is worth. The law recognises the participant&#8217;s spouse&#8217;s right to their portion of the share, but where the company&#8217;s own rules stand in the way of them actually joining it, that right resolves into money rather than membership. This is why, in practice, the business tends to stay whole and under the control of the spouse who runs it, while the division happens in value \u2014 one keeps the company, the other is paid out. It is usually the outcome that serves everyone: the business survives intact, the owner keeps control of it, and the other spouse still receives their fair share. And it is exactly why the argument, almost as soon as it begins, moves off the question of ownership and onto the question of worth \u2014 because once it is settled that one spouse keeps the business and the other is compensated, everything depends on the figure that compensation is built on. Its worth is not a figure sitting on a statement; it depends on its assets, its debts, its earnings, its prospects, and a set of assumptions that each spouse has every reason to pull in opposite directions, one reaching for the highest defensible number and the other for the lowest. A spouse who runs the business controls most of the information about it, and may be inclined to present it at its lowest ebb \u2014 to suppress its income, weigh it down with questionable debts, or quietly move value out of reach before the division is done. The honest reality is that getting the valuation right, and getting a full and truthful picture of the business behind it, is most of the battle \u2014 and the part of the whole exercise most worth putting effort and good advice into.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Protecting a business: the marriage contract and settling out of court<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Much of the anxiety a business brings to a divorce can be reduced, and some of it avoided entirely, by steps taken before or outside the courtroom.<\/p>\n\n<p class=\"wp-block-paragraph\">The most powerful is a marriage contract, which lets spouses set their own rules for property instead of taking the default of equal division. Short of a contract, a division need not be fought out in the <a href=\"https:\/\/court.gov.by\/\">courts<\/a> at all: spouses are free to divide their property, a business included, by agreement between themselves \u2014 recorded, where they wish, in a notarial agreement through the <a href=\"https:\/\/belnotary.by\/\">Belarusian Notary Chamber<\/a> \u2014 which is usually faster, cheaper and far less damaging to the business than litigation, and keeps the terms in their own hands rather than a judge&#8217;s. One practical caution belongs here as well. A claim to divide property after a divorce is not open indefinitely \u2014 a limitation period applies \u2014 so a spouse who intends to claim their share of a business should not sit on the right for too long, because leaving it can mean losing it. A business interest gained during the marriage is jointly acquired property, so your spouse is entitled to a share of its worth; in practice that is settled by you keeping the business and compensating them for their share, rather than by dividing the company. This is one of the main protections a business has in a divorce: your spouse is entitled to their share of what it is worth, not to a seat alongside you.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Do I have to sell the business to pay my spouse their share?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Rarely. The usual outcome is that you keep the business and pay your spouse compensation for their share of its value, rather than selling it to raise the money \u2014 the point of compensating in value is precisely to avoid forcing a sale and to let the business carry on. How the compensation is funded is its own question, but a division does not, in the ordinary case, require the business to be sold or broken up.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Is a business I owned before the marriage protected?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Largely, but not always completely. A business you owned before the marriage, or received by gift or inheritance, is in principle your own and stays out of the division. The complication is growth: if the business increased substantially in value during the marriage, or if marital money or your spouse&#8217;s work went into it, part of that increase can be treated as shared even though the business began as yours. So a pre-marital business is a good deal safer than one built during the marriage, but it is not automatically untouchable.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>How is a business valued in a divorce?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">By a proper valuation that looks at what the business actually is worth \u2014 its assets, debts, earnings and prospects \u2014 rather than any single figure from its accounts. Because a private business is hard to value and the number drives everything, valuation is usually the real battleground of a business division, and a credible, defensible valuation is worth investing in. Each spouse will tend to argue the value in their own direction, which is exactly why a sound independent basis for the figure matters so much.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>What if my spouse is hiding income or undervaluing the business?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">It is a common and answerable worry. A spouse who runs the business controls most of the information about it and may be tempted to show it at its worst \u2014 understating income, inflating debts, or moving value out of sight before the division. There are routes for compelling disclosure and bringing concealed or understated value back into the reckoning, so a business you suspect is being undervalued is not something you simply have to accept. Acting on it early, and with advice, gives the best chance of getting to the true picture.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Can a marriage contract protect my business?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Yes \u2014 it is one of the most effective ways to do so. A marriage contract lets you set your own rules for property instead of the default equal division, so you can agree that a business stays your own, or fix how it would be valued and shared if the marriage ended. For a business owner it is worth putting in place rather than relying on the default, and it can spare both spouses a great deal of the uncertainty and conflict that a business otherwise brings to a divorce.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>The value, not the business<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">For all the fear a business brings to a divorce, the thing most people dread \u2014 losing it, splitting it, selling it, sharing control of it with a former spouse \u2014 is usually not what happens. What a divorce divides is the value of the business, not the business itself. The company stays whole, stays with the spouse who runs it, and the other spouse is paid out their fair share of its worth. That quietly turns what feels like a threat to the business into what it really is: a question of money, and of the number that money is worked out from. The work stays with whoever does it; what is shared is the worth.<\/p>\n\n<p class=\"wp-block-paragraph\">Which is why the effort belongs where the dispute actually is \u2014 not in a fight over who keeps the company, which is usually settled before it starts, but in valuing the business properly, working out which part of it is truly marital, and, where it is needed, making sure the picture put forward is complete and honest.
