The court ruled, you have the papers, and as far as that country is concerned the marriage is long over. Then you need to sell a flat in Minsk that the foreign court divided, or collect the maintenance it ordered, or a custody question drags you back into the Belarusian system \u2014 and it turns out the judgment does not simply work here.<\/p>\n\n<p class=\"wp-block-paragraph\">The reason is a distinction most people never think about: a foreign divorce mostly needs to be recognised, and the parts that actually do things \u2014 maintenance, property, custody \u2014 need to be enforced, which is a different and harder thing. Recognition of the divorce itself is usually straightforward. Enforcing its orders depends on whether Belarus has a treaty, or reciprocity, with the country that issued them, and can be refused. Where it is refused or unavailable, you do not enforce the foreign judgment at all \u2014 you refile in Belarus. This piece is about which part of your judgment works, and which sends you back to court.<\/p>\n\n<p class=\"wp-block-paragraph\">It is general information, not legal advice. Cross-border cases turn on the country and the facts, so the specifics are worth checking against yours.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Recognition and enforcement are two different things<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Everything here follows from one distinction. Recognition means Belarus accepts the legal effect of a foreign judgment \u2014 that you are divorced, for instance. Enforcement means a Belarusian authority will act on it: make someone pay the maintenance, transfer the property, hand over the child. A divorce judgment is mostly a statement of status, so for the divorce itself you usually need only recognition. But the orders that ride along with a divorce \u2014 money, property, children \u2014 require enforcement, and that is where the difficulty lives. Conflating the two is the mistake that leaves people assuming the whole judgment is portable when only half of it is.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>The status: your foreign divorce is usually recognised<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Take the easy part first. Belarus recognises a foreign divorce granted under the law of the state that issued it \u2014 the rule in Article 231 of the <a href=\"https:\/\/pravo.by\/document\/?guid=3871&amp;p0=Hk9900278\">Marriage and Family Code<\/a> \u2014 provided the documents are properly legalised, by apostille or consular legalisation, and translated. One practical step people miss: because your marriage record sits in a Belarusian civil-registry office, the recognition should be reflected there, so the state\u2019s records actually show you as divorced. For remarrying or updating your status, the divorce itself generally holds. We cover the status question in full in our piece on <a href=\"https:\/\/familylawyer.by\/news\/is-a-foreign-divorce-recognized-in-belarus\/\">whether a foreign divorce is recognised in Belarus<\/a>; the rest of this article is about the harder part.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>The orders that must be enforced: maintenance, property, custody<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">The parts of the judgment that do things need more than recognition. To make a foreign maintenance or <a href=\"https:\/\/familylawyer.by\/pages\/razdel-imuschestva\/\">property<\/a> order bite in Belarus \u2014 to actually collect the money or transfer the <a href=\"https:\/\/familylawyer.by\/news\/foreign-property-belarus-divorce\/\">Minsk flat<\/a> \u2014 you go through the recognition-and-enforcement procedure: an application to the competent Belarusian court for permission to enforce the foreign judgment. And that permission turns on a treaty.<\/p>\n\n<p class=\"wp-block-paragraph\">Where Belarus has a legal-assistance treaty with the issuing country \u2014 the CIS <a href=\"https:\/\/etalonline.by\/document\/?regnum=N09300004\">Minsk Convention of 1993 and the Chisinau Convention of 2002<\/a>, or a bilateral treaty \u2014 there is a defined path, and <a href=\"https:\/\/court.gov.by\/ru\/jurisprudence\/post_plen\/civil\/matrimony\/3bf30530559e47c5.html\">the recognition-and-enforcement route works<\/a>, if more slowly than a purely domestic case. Even without a treaty, reciprocity can provide a basis. For maintenance specifically, Belarus is also party to the 1956 UN Convention on the Recovery Abroad of Maintenance, which adds a channel. You will need the judgment finalised, legalised, translated and accompanied by proof the defendant was properly notified, and you have three years from the judgment becoming final to present it for enforcement.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>When it works<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">So when does a foreign divorce judgment genuinely take effect in Belarus? The divorce status is the easy half: meet <a href=\"https:\/\/etalonline.by\/document\/?regnum=hk9900278\">Article 231<\/a>, have your documents in order, and it usually goes through. An ancillary order asks more of you \u2014 it needs to come from a country that has a treaty with Belarus, or with which reciprocity has been established; the judgment has to be final; the defendant must have been properly served; the matter can&#8217;t have been one only a Belarusian court could decide; and enforcing it mustn&#8217;t run against Belarusian public policy. Tick those boxes and you&#8217;re on the clean path, the one most judgments from CIS states and plenty of bilateral-treaty countries take. With the treaty in place and the paperwork right, recognition and enforcement is just a procedure \u2014 not a fight.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>When it\u2019s refused, and you refile<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">The harder cases are where enforcement is refused \u2014 and refusal is common. There is no treaty and no established reciprocity with the country: recognition of ordinary court judgments from, say, Germany, France, the UK or the Netherlands is very difficult in Belarus on that basis alone. The defendant was not properly notified. The matter fell under Belarus\u2019s exclusive jurisdiction. The foreign order contradicts a Belarusian judgment. The three-year window has passed. Or enforcing it would offend public policy.<\/p>\n\n<p class=\"wp-block-paragraph\">When enforcement is off the table, you do not force the foreign judgment \u2014 you refile: you bring the maintenance, <a href=\"https:\/\/familylawyer.by\/pages\/razdel-imuschestva\/\">property<\/a> or <a href=\"https:\/\/familylawyer.by\/pages\/opredelenie-mesta-zhitelstva-rebenka\">custody<\/a> claim afresh in a Belarusian court and have it decided here. The divorce status can still stand even though the ancillary order cannot be enforced, so you may recognise the divorce and re-litigate only the money or the flat. Children are a category of their own: whatever a foreign court ordered, a Belarusian court will <a href=\"https:\/\/court.gov.by\/ru\/jurisprudence\/post_plen\/civil\/matrimony\/e9050b2daca94052.html\">weigh the child\u2019s current interests<\/a> and often re-decide residence and contact regardless. \u201cRefile\u201d is not a failure; for many countries it is simply the route.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>How to decide, and how to do it right<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Two moves make this manageable. First, put the country on the map: is there a treaty, or established reciprocity, with the state that issued the judgment? That one fact decides whether you&#8217;re enforcing or refiling. Second, split the judgment by part \u2014 recognise the divorce status, and pursue each ancillary order separately, by enforcement or by refiling. Either way, get the judgment finalised, legalised and translated. And if you&#8217;re still <a href=\"https:\/\/familylawyer.by\/pages\/rastorzhenie-braka\/\">divorcing<\/a>, or the <a href=\"https:\/\/familylawyer.by\/pages\/rastorzhenie-braka-s-inostrancem\">divorce involves a foreigner<\/a>, building enforceability in from the start \u2014 jurisdiction, service, where the assets sit \u2014 saves you this whole problem down the line. Belarus recognises a foreign divorce granted under the law of the country that issued it, provided the documents are legalised and translated, and the recognition should be reflected in the Belarusian civil-registry record. That is separate from enforcing any maintenance, property or custody orders the divorce came with.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Do I need to do anything to be considered divorced here?<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">You should have the recognition reflected in the Belarusian civil-registry office that holds your marriage record, so the state\u2019s databases show you as divorced. Until that is done, Belarusian records may still show you as married whatever the foreign papers say \u2014 which matters if you want to remarry.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Can I enforce a foreign maintenance order in Belarus?<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">If there is a treaty or reciprocity with the country, yes \u2014 through the recognition-and-enforcement procedure, and for maintenance there is also the 1956 UN Convention on the Recovery Abroad of Maintenance. Without a treaty or reciprocity, enforcement may be unavailable, and you would refile the maintenance claim in Belarus.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>What if there\u2019s no treaty with the country that granted my divorce?<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">The divorce status can still be recognised, but enforcing its ancillary orders becomes very difficult \u2014 recognition of ordinary judgments from non-treaty countries is generally not available in Belarus unless reciprocity is established. In practice that usually means refiling the money, property or custody question in a Belarusian court.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>On what grounds is enforcement refused?<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">The main ones: no treaty and no reciprocity; the defendant was not properly notified; the matter was within Belarus\u2019s exclusive jurisdiction; the foreign order contradicts a Belarusian judgment; the enforcement term has expired; or enforcing it would offend public policy. Any of these can stop enforcement even where the divorce status is recognised.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>What does \u201crefile\u201d actually mean?<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">Bringing the claim again in a Belarusian court \u2014 suing for the maintenance, the division of property, or the custody arrangement here, rather than trying to enforce the foreign order. You may recognise the divorce itself and still have to refile the ancillary matters. It is slower than enforcing a good foreign judgment, but where enforcement is unavailable it is the route.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Will a foreign custody order be enforced, or will a Belarusian court re-decide?<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">Children are treated differently. Even where a foreign order exists, a Belarusian court weighs the child\u2019s current best interests and will often re-decide residence and contact rather than simply enforce the foreign order. A foreign custody ruling is a strong fact, not a guaranteed outcome.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>How long do I have to enforce a foreign judgment?<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">Generally three years from the date the judgment became final. Miss that window and enforcement can be refused on that ground alone, which \u2014 again \u2014 pushes you toward refiling in Belarus. If you have a foreign judgment you may need to enforce here, do not sit on it.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Conclusion<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">A foreign divorce is recognised in Belarus far more readily than its orders are enforced. The status usually holds; the maintenance, property and custody parts depend on a treaty or reciprocity and can be refused, in which case the answer is not to force the foreign judgment but to refile and litigate here.
